E-Gift Card Terms and Conditions

These regulations are intended exclusively for consumers within the meaning of applicable laws in Poland and govern the rules of purchasing and using electronic e-Gift Cards within the online store Easy-surfshop. These e-Gift Cards are issued to the bearer and are valid for a period of 12 months (365 days) from the moment they are sent to the email address specified by the purchaser after the purchase.


1. General Provisions

  1. These regulations define the rules for the purchase and use of e-Gift Cards within the Online Store. Their purpose is to create clear, secure, and fair relations between participants in the transaction.

  2. The regulations contain essential information regarding the rights and obligations of the Customer and the Issuer.

  3. Terms written in capital letters but not defined in these regulations have the meaning assigned to them by the Online Store's general regulations, available here, unless otherwise stated.

  4. If terms written in capital letters have been defined both in these regulations and in the Online Store regulations, the definition in these regulations takes precedence.


2. Definitions

  • E-Gift Card / Card – an electronic discount voucher recorded in non-material form, sold by the Online Store to the bearer, allowing for a discount of a specified amount during payment for products in the Online Store. The e-Gift Card is not an electronic payment instrument or a bank-issued payment card. It serves as an identification voucher under Article 92115 of the Civil Code of Poland.

  • Discount Code – a sequence of characters assigned to the e-Gift Card, which, when entered at checkout, grants a one-time discount equal to the Card's value.

  • Purchaser – a natural person who is a consumer within the meaning of Article 221 of the Civil Code and has purchased an e-Gift Card in the Online Store.

  • User – the Purchaser or any bearer who is a consumer and possesses the e-Gift Card, using it for payment within the Online Store.

  • Issuer – EASY-surfshop, operated by Bartosz Grzesiek under the business name EASY SURF Bartosz Grzesiek, located at ul. Św. Michała 100, 61-005 Poznań, Poland. The business is registered in the Central Register and Information on Economic Activity (CEIDG) and operates under NIP: 7821239556, REGON: 631147690.


3. Rules for Acquiring e-Gift Cards

  1. The e-Gift Card can be acquired and used only by a Consumer.

  2. The Issuer allows the purchase of e-Gift Cards in the Online Store in fixed denominations: €25, €50, €100, €250, €500, and €1000.

  3. The Purchaser cannot exchange the e-Gift Card for cash, in whole or in part.

  4. The e-Gift Card value does not accrue interest and cannot be increased once issued.

  5. The Purchaser pays for the e-Gift Card through available payment methods in the Online Store. An e-Gift Card cannot be used to purchase another e-Gift Card.

  6. Discount codes cannot be applied when purchasing e-Gift Card.

  7. The e-Gift Card is delivered electronically in PDF format to the Purchaser’s email address. The Purchaser cannot request a physical version.

  8. The e-Gift Card is sent within business hours. If purchased outside business hours, it will be sent on the next business day.

  9. Once issued, an e-Gift Card cannot be returned. By purchasing an e-Gift Card, the Purchaser agrees to waive the right of withdrawal under Article 38 of the Consumer Rights Act.


4. Rules for Using the e-Gift Card

  1. The e-Gift Card can only be used once within its validity period.

  2. If the total order value exceeds the Card’s balance, the User must pay the difference using another available payment method.

  3. If the total order value is lower than the e-Gift Card’s balance, the remaining amount is forfeited – partial redemption or refunds of unused funds are not possible.

  4. The e-Gift Card cannot be used in the EASY-surfshop physical store; it is valid only for online purchases.

  5. The Issuer is not responsible for lost or stolen e-Gift Cards or cases where the Purchaser provided an incorrect email address.

  6. The Issuer has the right to refuse payment with an e-Gift Card in case of technical issues but will restore the functionality as soon as possible.


5. Returns & Refunds for Orders Paid with e-Gift Cards

  1. If an order paid with an e-Gift Card is returned, the refund is credited back to the same e-Gift Card.

  2. If the payment was made partially with an e-Gift Card and another payment method, the refund will be split accordingly.

  3. The e-Gift Card cannot be refunded or converted to cash.


6. Complaints & Dispute Resolution

  1. Any complaints related to the e-Gift Card can be submitted via email to info@easy-surfshop.com or in writing to: EASY-surfshop, ul. Św. Michała 100, 61-005 Poznań, Poland.

  2. The Issuer will review complaints within 14 days from the date of receipt.

  3. If a complaint is not resolved in favor of the User, they have the right to pursue out-of-court dispute resolution via the Online Dispute Resolution (ODR) platform.


7. Personal Data Protection

  1. Personal data provided by the Purchaser is processed by the Issuer as the data administrator.

  2. Providing personal data is voluntary but necessary for the purchase and fulfillment of the e-Gift Card.

  3. Detailed information on personal data protection is available in the Privacy Policy


8. Amendments to the Regulations

  1. The Issuer reserves the right to modify these regulations in case of:

    • Changes in legal requirements.

    • Technological advancements affecting service provision.

    • Introduction of new functionalities or modifications to existing ones.

  2. Changes take effect immediately upon publication on www.easy-surfshop.com and do not affect previously issued e-Gift Cards.


9. Final Provisions

  1. These regulations come into effect on 16.02.2025.

  2. Matters not covered in these regulations are subject to Polish law.

  3. Choosing Polish law does not deprive consumers of protections granted under mandatory legal provisions.
